Kosovon perustuslaki tuli voimaan 15. kesäkuuta 2008. Tätä ennen Kosovossa oli voimassa Yhdistyneiden kansakuntien turvallisuusneuvoston päätöslauselmaan numero 1244 perustuva väliaikainen perustuslaki, joka voimaansaatettiin vuonna 2001. Serbian hallitus ei tunnusta perustuslakia, vaan katsoo Kosovon olevan osa Serbiaa.


Perustuslaista julkaistiin alustava versio huhtikuussa 2008. Esitys perustuu pitkälti presidentti Ahtisaaren laatimaan ns. Ahtisaaren suunnitelmaan, joka takasi vähemmistöryhmille erityisoikeuksia ja turvallisemman ympäristön kaikille Kosovon asukkaille.


Kosovon perustuslaki ratifioitiin 9. huhtikuuta 2008 ja se tuli voimaan kesäkuussa 2008. Kosovossa on kuitenkin edelleen toiminnassa YK:n UNMIK-operaatio. Uutta perustuslakia ei sovelleta Kosovon sisällä olevilla serbien asuttamilla alueilla.
